Which terms apply
The Registration Agreement is the general contract for the domain names you register through Domgate. Service terms add the rules of each service, such as a local presence.
Domgate sells its services to professionals: resellers, registrars and companies.
These service terms supplement the Registration Agreement. Where the terms of a service differ from the Registration Agreement, the terms of that service prevail for that service.
Service terms
Where a service has terms of its own, they are published on a page of their own.
Each service that has its own terms is listed here.
Acceptable use and content restrictions
The uses Domgate does not accept are set out in the "Right of Refusal, Service Cancellation, Acceptable Use Policy" section of our Registration Agreement. Other sections of the agreement also allow Domgate to refuse, suspend or cancel a service, notably "Fees and Payment", "Agreement Termination", "Service Interruption" and "General Requirements".
Every abuse report is examined by one of our experts and passed on to the holder of the domain name, who can then give explanations and evidence that there is no abuse.
The domain name is suspended at once, as a precaution, when:
- the abuse is clearly deliberate in our experts' analysis, for example a well-known trademark registered without a legitimate reason, phishing, or a domain name used to spread malware or to impersonate a person or an organisation;
- the abuse concerns a domain name registered with our local presence service: no abuse is accepted when our local presence is used;
- the holder has already been found responsible for an abuse, with the same domain name or another one.
In the other cases, the domain name and the related services are not suspended at once: the holder has 2 to 5 days to give explanations and evidence. After that time, without a sufficient justification, the domain name and the related services are suspended. If the abuse is repeated, Domgate terminates the services concerned and may refuse any new order from the holder.
Payment
All Domgate services are paid in advance. Domgate does not renew a service that has not been paid in advance.
If an amount is nevertheless paid after its due date, late-payment penalties are due from the day after that date, at the rate of the European Central Bank's most recent refinancing operation plus 10 percentage points, together with a fixed indemnity of 40 euros for recovery costs (Code de commerce, art. L441-10 and D441-5).
Reporting abuse
Report abuse, such as phishing, malware, spam or illegal content, through our abuse form on portal.domgate.com. Public authorities: please use our law enforcement page.
For content we host (websites, and e-mail stored in our mailboxes), your report should give:
- the reasons why you consider the content illegal;
- its exact electronic location, such as the URL;
- your name and e-mail address, except when you report child sexual abuse material or another offence against children listed in Articles 3 to 7 of Directive 2011/93/EU (sexual abuse, sexual exploitation, child pornography, solicitation);
- a statement that you believe in good faith that the information and allegations in your report are accurate and complete.
These are the elements listed in Article 16 of the Digital Services Act (Regulation (EU) 2022/2065).
Domgate confirms receipt of each report to the e-mail address given, then tells the reporter its decision and the ways to contest it (Regulation (EU) 2022/2065, Art. 16(4) and (5)).
Decisions and how to contest them
When Domgate removes or restricts access to content it hosts, or suspends or ends a hosting service or an account, because the content is illegal or incompatible with our terms, it sends the customer a statement of reasons, when it has the customer's e-mail address. The statement gives the measure, its scope and duration, the facts and circumstances, whether automated means were used, the legal or contractual ground, and the ways to contest the decision (Regulation (EU) 2022/2065, Art. 17).
You can contest a decision through our refunds and complaints page.
Changes to these terms
Under the "Modification" section of our Registration Agreement, a change becomes binding thirty days after the revised text is posted on our website, or on notice to you by e-mail.
We inform the users of our services of any significant change to these terms (Regulation (EU) 2022/2065, Art. 14(2)).
Domgate e-mails customers before a significant change takes effect.
