Registering a trademark in one country or two hundred
A trademark gives you the exclusive right to use a sign, a name or a logo, for the goods and services you choose, in the country where it is registered. Why domains and trademarks go together
A registered trademark is the evidence you need to recover a domain that infringes your rights, whether through a dispute procedure or before a court. It is also, for some country code extensions, an alternative to a local presence: a trademark registered in the country opens the door to the extension. And a domain strategy decided by market usually follows the trademark strategy: the same countries, the same names. Handling both in one place avoids the gaps that appear when they are managed by different teams.
How a filing goes
- Preliminary study. We search the registers of the country for identical or similar marks in the classes you need, and tell you what the risks are before you file.
- Application. The local attorney files the application with the national office, in the local language and form, with the classes and the representation of the mark.
- Examination and opposition. The office examines the application; in most countries a publication opens a period during which third parties can oppose. We answer the office and keep you informed.
- Registration certificate. Once granted, the certificate is issued and stored in your account, with the renewal date.
Our prices are quoted per country and per class, and include the preliminary study, the application, the registration certificate and the attorney fees. Legal defence, for example answering an opposition, is quoted separately when it arises.
Classes, duration, renewals
Goods and services are grouped into 45 classes under the international classification used by most offices. You register the mark in the classes that match what you sell; each additional class is an additional fee. In most countries a trademark lasts ten years and is renewable without limit, as long as it is used. Your account shows the renewal dates of all your marks next to those of your domains.
Where to file
There is no world trademark. You file country by country, or through a regional system where one exists, and in most countries you have six months after a first filing to extend it abroad while keeping the date of the first one. A common approach is to file first in the home market, then in the countries where the goods are sold or made, then in the countries where counterfeiting is frequent. We help you draw that list against your domain portfolio, so that each market has both its trademark and its country code domain.
Timing
The time to registration depends on the office: a few months in some countries, more than a year in others, longer if an opposition is filed. The preliminary study, on the other hand, takes days. We give you the expected timing per country before you order.
